we're at the top of the park where there's still a thick layer of mud covering the area. again, they are going to be here in just a few hours. equipment is already in place for the second round of clean- up. the water main break caused a mess. clean-up crews were working well into the night to do as much as they can. you can see that thick layer of mud covering the roads in front of neighbors's homes. now, from above, our chopper 5 shows you just how far it extend out. this is what neighbors woke up to abruptly at 4:30 a.m. 12 homes were evacuated after 45,000 gallons of water caused that landslide. thankfully there were no damage to homes but neighbors say they are still worried about the safety of the hillside. >> hopefully there's nothing really going to happen at all especially with the rain coming this weekend. >> are you worried about that and the stability of the hill. >> better to update us as soon as possible. >> reporter: engineers tested the hill before allowing people back in their homes and city

officials say an 8" pipe connected to a water tank burst, causing the landslide. they blame the pipe's old age, that pipe was made in the 1930s. city officials plan to repair or restore the pipes in the area and say there could be more aging pipes similar to the one that burst yesterday. live in daly city, cate caugiran, cbs 5. >> thank you. big question now, who is going to pay for all the clean- up? car owners whose auto insurance policies do include a comprehensive coverage are automatically protected no matter where the car was parked. but you should make the claim immediately. drivers who don't have the comprehensive coverage should submit a claim to daly city within the next six months. forms are available at city hall. an attic fire in the east bay forced a family out of their home. one firefighter suffered minor injuries. crews took 20 minutes to knock the fire down. they spent hours dealing with the flare-ups.

that's due to complications from a new roof on the home. the residents inside smelled smoke before the alarms went off. san francisco city hall will be open for business today. this is a live look at city hall. it's running on a generator right now. pg&e crews are working to get powerfully restored there. and last night an electrical problem in the basement set off the smoke alarms forcing everyone inside to evacuate. the sprinklers went off causing minor damage inside. sierra lamar's accused killer facing new charges. 21-year-old antolin garcia torres is charged with three other kidnappings in 2009. sierra lamar disappeared this year. torres was arrested in may for her kidnapping and murder. her body hasn't been found. the first look at two men who police say kidnapped a woman threw her in the back of her own car and then drove her around from atm to atm.

cbs 5 reporter anne makovec in walnut creek with some new surveillance video just released and she is going to share it with us. >> reporter: it all started in the shade lands business park area of walnut creek. police say the woman kidnapped was in the wrong place at the wrong time. they have been getting tips overnight since they released new surveillance video yesterday afternoon but they are still looking for more tips. we want to show you these pictures one more time. surveillance video from one of the banks where the kidnappers tried to withdraw cash from the woman's account. the whole time she was tied up in the back of the car after about three hours they let her go in the oakland hills. the description we are looking at right now, two white men in their early 20s, one 5'9", one 5'11". the taller one possibly named david has broad shoulders, dark hair. the shorter one possibly named aubrey was skinny and is the guy that you saw in the photos. once they dropped the woman off in the oakland hills, they

drove away in a dark small colored or dark colored small pickup truck with a loud muffler. those are the clues. and with the pictures they are pretty clear, walnut creek police hope somebody will recognize at least one of the guys and if you do, of course, call the walnut creek police. anne makovec, cbs 5. let's check weather. i guess we should enjoy today because some changes are coming. >> but sunshine today, right? >> sunshine. and we should enjoy every day. >> true! >> i love the rain, too. but yeah, we do have some changes coming our way. outside right now, a few high clouds cruising overhead making for a beautiful start to the day but we are going to see plenty of sunshine and it looks like some very nice temperatures. probably the warmest of the week. 40s and 50s right now. and by the afternoon, that sunshine going to crank these temperatures up into the 70s. right now though high pressure still holding strong although a lot of clouds moving across the top of the ridge. by the afternoon, a lot of sunshine, just a couple of

passing clouds and temperatures even warmer than yesterday. yesterday wasn't bad. but today we are going to see a lot of 70s showing up about 70 degrees in concord. 70 in san francisco. and 72 in san jose. this is about as good as it gets though this week. we have some rain on the horizon. we'll talk more about that in a moment. right now let's check the roads with elizabeth. >> we are going to enjoy this dry commute while we can. we are following a couple of problems though. we are seeing in the usual amount of delays right -- an unusual amount of delays right now on westbound 4 because of an accident not even blocking lanes. it's off to the shoulder approaching a street lone tree way but unfortunately it's causing heavy traffic right now through antioch. also reports of an accident westbound 580 approaching santa rita, tassajara. we can't see it but we are seeing bunching up but we have delays stop and go from the altamont pass to the dublin interchange. the nimitz 880 through oakland near the oakland coliseum, no problems. 16 minutes between 238 and the maze. and a quick note for the south bay commute in san jose, they

monday. back to you. uc leaders are delaying the vote on raising student fees. the move comes after requests from governor brown. he questioned the timing of raising tuition a week after voters passed prop 30 to fund education. the uc system was look at raising fees by as much as 35%. yesterday cal state trustees also delayed a vote on a proposal to raise fees. well, some naked people are likely to show up on the steps of san francisco city hall at noon today. a protest is planned against a proposed ban on nudity in the city. a lawyer says she plans to take the case to federal court. she wants to block san francisco supervisors from voting next tuesday on the ban. >> i think lawrence should do his weather live from city hall steps today. >> i think so too at noon. great. >> it would be funny. 6:19. a judge in ohio plans to keep watch today over a woman serving a strange sentence. she was sentenced to two days

clean it all up if not already, cate. good morning. >> reporter: good morning. they got most of it from the road but it's still thick mud in the park. look at the mess from yesterday. you can see that mud inches deep covering that road in front of neighbors' homes. that water main burst brought down that inches thick of muck, silt and dirt. the clean-up went well into the night in this daly city neighborhood. look from chopper 5, neighbors were startled at 4:30 a.m. when police told them to leave their homes after 45,000 gallons of water came downhill. city leaders say it was because of a cast iron pipe that broke and that was made in the 1930s. >> you can see the pipe sheared off. we have an aging system. we know we have pipes in the ground that are possibly, you know, close or past their useful life. that's not uncommon within any bay area community. >> reporter: no homes were damaged. about 12 families evacuated.

business park in the shadelands area. police say this 57-year-old woman who was kidnapped was in the wrong place at the wrong time. now, here are the surveillance video pictures that they have been trying to circulate since yesterday. this is from one of the banks where the kidnappers tried to withdraw cash from the woman's account all while she was tied up in the back of her own car. after about 3 hours, they left her go in the oakland hills and she is okay. these guys are identified as white men both in their early 20s. now, one of them was 5'11", 185 pounds with broad shoulders wearing a black sipup collared shirt a t-shirt and jeans. the other guy was 5'9", skinny about 150 pounds, wearing a black hoodie and dark jeans. at one point he was wearing a mask. now, two names were bantered about in the car that night according to the woman. david and aubrey. and police don't know if those are these guys' real names or

they have been on since about 6:15. so you're jammed up almost to the macarthur maze. that is traffic. back to you guys. >> thank you. three people are dead after the fiery crash of a single- engine plane in mississippi. the piper pa32 had just taken off from jackson when it crashed into a home yesterday. one person in that burning home escaped with minor injuries. no one else was hurt. the cause is still unclear. all three victims on board were pilots traveling to a federal aviation administration safety conference. an e.r. doctoof the year is accused of causing a dramatic crash in massachusetts. an suv comes out of a parking lot over a grassy area and crashes into that car. the impact pushed it into a truck in the next lane. dr. kristin howard is accused of driving under the influence of alcohol and drugs. >> wow. hearings are planned on

ashley morrison of cbsmoneywatch.com is in for jason brooks with an update. good morning. >> reporter: good morning. asian stocks got a lift overnight after greece held a sale of short term treasury bills on tuesday. the nikkei added a fraction breaking a seven-day losing streak white hong kong's hang seng gained 1%. a better-than-expected earnings report from sis so. the blue chip stock is rallying as much as 7% after cisco beat analyst estimates. the company saw a pickup in orders from large u.s. businesses that has been giving stocks a little bump on wall street. let's see how we're doing. the dow is up by 10 points. the nasdaq is climbing 15. and millions of shares of facebook could be looking for an investor to friend them on the stock market today. a lockup period on stock issued to the social networking company's first employees and investors ends today. now they can unload the stock that's lost nearly half of its value since facebook's ipo in

may when its stock was offered at $38 a share. we'll see a lot of defriending going on. >> i think you're right. hey, earlier this morning, you admitted to us that you are a big texter. >> reporter: yes, i am. and some people are saying it's going out of style but i say no way. according to one tech analyst people are texting less. for the first time, the number of monthly texts dropped slightly. on average, people send 675 texts a month of that's compared to the 700 they were sending earlier in the year. but it's not that people are communicating less but, instead of texting they are using apps like skype, google voice and facebook to get the services that also like apple's i message and blackberry's messenger but i have to say, yes, i'm a big texter. 675 sounded like a low number to me. >> that's only about 20 a day. how many do you do in a day? >> i don't know. and i don't think i want to look. i might need an intervention! restore power on the 3rd and 4th floors of san francisco city hall. this is a live look there. i believe you can hear the generator. they are going to run on generator power when it opens for business today. crews are trying to figure out what sparked an electrical problem in the basement last night. the sprinklers went off causing minor damage inside. the electrical wiring was installed in 1999 after the loma prieta earthquake. sources say that nancy pelosi intends to remain as house minority leader. the news comes despite democrats failing to gain the 25 seats needed to win the house majority. about 20 minutes ago a congressional official said mostly just broke the news -- pelosi just broke the news to her party caucus ahead of a news conference scheduled in a few minutes from now. this had been speculation she would step down from her post. last week she breezed to re- election in her heavily democratic san francisco district. but again she is going to remain. >> somebody leaked that in her
